Question. Can we make judges and advocates[ by active advocacy ] sensitized about their responsibility of justice

Answer. 1- before sending the notice to a dr, allegation and evidence can easily be scrutinized by learned advocate- whether it is poor or unexpected result or negligence in standard medical care.
if negligence then at least some evidence is attached or not, if no attachment then it should not be entertained

2- only after this the doctor should get notice from court [ notice must be attached with court verified evidence ]
usually we get only notice without any papers of supporting evidence

जी हां। सरकार द्वारा जारी पत्र के अनुसार अब यह देय है।
अलग अलग शहरों में यह अलग हो सकता है।

Query- There is a debate going on in the news paper & internet regarding general surgeon that he can not perform Hysterectomy or LSCS. What is your opinion in this matter?

Answer- There is no doubt that a general surgeon is competent to do hysterectomy or LSCS but it should be done only in case of emergency. I have observed that  many surgeons  are routinely doing LSCS at many nursing homes / hospitals especially in small cities. Many such surgeons are doing these practices while assisting their wives in maternity nursing home and some have no other surgical practice except LSCS routinely.
In case of negligence, court will take a serious note of that as this practice is unusual for a general surgeon as they have not been trained in performing LSCS in course curriculum. Only justification is emergency when obstetrician is not available
